Litigation Track Records

Examples of the litigation matters we have handled recently include:

  • Shipping and Transport cases: The litigation cases that our Shipping, Transport and Insurance department deals with are too numerous to list. These cases are characterised by the need to coordinate action in several jurisdictions: their urgency, typically including summary proceedings, the inclusion of surveys by court-appointed surveyors, and the use of arrest and attachment proceedings.

  • Distribution and Agency Cases: Our lawyers have acted as counsel in a large number of disputes related to the termination of exclusive distributorship agreements and commercial agency contracts in Belgium and other EU countries, with activities ranging from pre-litigation advice, settlement negotiations, to full-blown proceedings.

  • Environmental cases: The firm handles proceedings before the Council of State (‘Raad van State’ / ‘Conseil d’Etat’) and the civil courts in environmental and administrative law matters and also acts as counsel for various public authorities in proceedings launched before the Council of State against administrative decisions regarding land allocation plans, building permits, and environmental permits.

  • Insurance Cases: We are acting as counsel in a claim under an insurance policy covering guarantees given by national professional trucking companies associations.

  • Employment Cases: We have represented numerous clients in employment-related litigation throughout Belgium.

  • IP Cases: We represent a major Belgian retailer, among others, in a variety of copyright, trademark and design right litigations.
